Eligibility Requirements

Extraordinary ability, demonstrated by national or international recognition, and you intend to continue working in your field of expertise in the United States.
There are two ways to meet this requirement:
One-time major award: Such as a Nobel Prize, Oscar, Olympic Medal, Pulitzer Prize, or another internationally recognized equivalent award. Holding such an award makes the qualification process straightforward.
Without a major award: You must meet at least 3 out of the 10 criteria established by USCIS to demonstrate sustained national or international acclaim.

Application Process

Steps to obtain permanent residence through the EB-1A Visa.

Step 1: Prepare application documents.

Step 2: Submit Form I-140 to USCIS.

Step 3: USCIS reviews the I-140 petition.

Step 4: After the I-140 is approved –

If you are in the U.S.: File Form I-485 (Adjustment of Status) to change your status to permanent resident.

If you are outside the U.S. (e.g., in Vietnam): Go through Consular Processing via NVC, complete Form DS-260, and attend an interview at the U.S. Consulate.

Step 5: Wait for the decision on your I-485 / DS-260 application.

Step 6: Receive Green Card.
